The special CBI court today reserved order for the bail pleas of Kanimozhi and others till 3 November. This effectively means that Kanimozhi will be spending diwali behind bars.

The order comes as a huge setback to DMK chief Karunananidhi, who has been in Delhi, in expectation that his daughter would spend diwali with him back home.

Earlier, in its reply to Kanimozhi’s bail plea, the CBI said it was not opposed to her bail. The CBI told the court that it was not opposed to bail of Kanimozhi, Sharath Kumar, Rajeev Agarwal, Asif Balwa and Karim Morani.

Former DMK MP and 2G scam accused Kanimozhi pleaded for bail in the Patiala House Court today morning.

Senior advocate Altaf Ahmed told Special CBI Judge OP Saini that as per the 22 June order of the apex court, both Kanimozhi and Kalaignar TV MD Sharad Kumar could approach the special court seeking bail after framing of charges.

“As per the Supreme Court order on 22 June in the case of Kanimozhi and Sharad Kumar, liberty was given to them to file fresh application for bail before the special court after framing of charges,” Ahmed said.

The counsel said as a result of this it is now a fit case for bail.

She had earlier also pleaded for bail but was refused by the trial court, Delhi High Court as well as the Supreme Court.

The apex court, while rejecting her bail, had said that she could move afresh for the bail after charges are framed against her and other accused in the 2G scam.

The bail hearings of the seven accused in the 2G scam case are being heard by the Patiala House Court in Delhi today. The special CBI court had framed charges against all 14 accused on Saturday.

Kanimozhi, who has been behind bars since May this year, has applied for bail on grounds that she is a woman. Kanimozhi is also likely to contend that the charges of accepting bribe and hatching a criminal conspiracy have been framed against her. The CBI has said it will not oppose her plea.

Among the other bail pleas which are coming up for hearing today are Kalaignar TV MD Sharath Kumar, Shahid Balwa’s brother Rajiv Agarwal, Cineyug’s Karim Morani and Kusegaon reality’s Rajeev Agarwal.

All the accused have pleaded not guilty and are expected to appeal against the charges in the court.

The 2G special court is also likely to hear the arguments of Janata Party chief Subramian Swamy, who is moving for Union Home Minister P Chidambaram to also be named as a co-accused.

Meanwhile Kanimozhi’s father and DMK patriarch Karunanidhi is in Delhi, hopeful of getting bail for his daughter before diwali.
