The woman who accused Australian cricketer Luke Pomersbach of molestation and assault could withdraw her case against him but despite that the Delhi High court might have to take the final call on whether the FIR against the sportsman can be quashed.
Pheroz, brother of Sahil Peerzada who was reportedly assaulted by Pomersbach, said that if the Australian cricketer apologised, they were willing to drop the case against him.
“He should have respect for women. Luke has done a blunder. He should apologise and we should also forgive and forget,” he said.
“We don’t want to pursue against Luke. We have not been pressurised by anyone. No one has approached us,” he told Headlines Today.
He also said they do not want to pursue a case against Siddhartha Mallya whose tweets casting aspersions on the woman’s character caused another controversy. Pheroz also denied the woman, Zohal Hamid’s, claim that she was Sahil’s fiancee.
“Sidhartha is a young man and must have tweeted in anger. We have high respect for Mallya for what he has done. Vijay Mallya is a visionary. We don’t want to pursue any case against Sidhartha Mallya either,” he said.
A settlement between the two parties can be reached without moving court only if the offence is compoundable.
In the FIR filed against Pomersbach contains four IPC sections. Out of these, two are comopundable (sections 323 and 354) and the other two are non-compoundable (section 452 and 511). Given this the Delhi High Court may take a final call on quashing of FIR.
Sources told Firstpost that Zohal’s lawyer has finalized a settlement deed which will be presented before the High Court.
On Tuesday, Delhi police told Firstpost that it will file the charge sheet against Pomersbach by the end of next week. The police has questioned more than 20 people in the case including Sahil Peerzada’s friends and Luke’s team mate KP Appanna.
The victim, Hamid, had also threatened Mallya with legal action after he tweeted following the incident casting aspersions on her character. Despite her demand for an apology, Mallya has still not given one.
Pomersbach is currently out on bail after being arrested following the incident.
