Delhi HC reserves order on ex-Haryana CM OP Chautala plea seeking suspension of sentence

Delhi HC reserves order on ex-Haryana CM OP Chautala plea seeking suspension of sentence

New Delhi: The Delhi High Court on Monday reserved order on the point of ‘suspension of the sentence’ on former Haryana Chief Minister Om Prakash Chautala’s plea challenging the trial court order which had sentenced him for four years of imprisonment in a disproportionate assets (DA) case.

The Bench of Justice Yogesh Khanna on Monday reserved the order and said it will pass the appropriate order later. Meanwhile, Chautala’s main appeal challenging his conviction and trial court judgement will keep pending for detailed arguments. Earlier the Bench had sought the response of the investigation agency Central Bureau of Investigation (CBI).

Senior Advocate N Hariharan and Senior Advocate Sunil Dalal appeared for the OP Chautala on Monday. Advocate Anupam Sharma appeared for CBI in the case and opposed the suspension of sentence plea moved by OP Chautala.

On 27 May, 2022, the Rouse Avenue Court of Delhi ordered four years imprisonment to Om Prakash Chautala, also ordered to confiscate four properties of him and also imposed a fine of Rs 50 lakh.

During the argument before Trial Court, OP Chautala’s lawyer, Advocate Harsh Sharma had cited medical grounds for less punishment and submitted that “I (OP Chautala) have been infected with polio since birth, and I am partially disabled.”

CBI’s Special Public Prosecutor Ajay Gupta had opposed the submissions of Chautala’s lawyer for a grant of concession on the ground of ill health and age.

CBI had urged the court for maximum punishment for Chautala shall be given as it would send a message to society. “The person, in this case, is a public figure and giving minimum punishment would send a wrong message. He is not having clean antecedents. It is the second case in which he has been convicted,” CBI said.
