A Special CBI court hearing the Aarushi-Hemraj double murder case is expected to pass a crucial order on Friday that will decide whether there is enough evidence to continue the probe against Aarushi’s parents, Rajesh and Nupur Talwar, who are the main accused in the case.

Now that the cross examination of prosecution witnesses has been completed, the special Ghaziabad court will decide if there is enough evidence to continue the trial against Rajesh and Nupur Talwar or acquit them under section 232 of CrPC.

This decision will be followed by the deposition and cross examination of defence witnesses. However, the order can be delayed if the defence move a fresh application stating that they will  after the statement of the accused is recorded.

Earlier the Supreme Court dismissed dentist couple Rajesh and Nupur Talwar’s plea against CBI for dropping its 14 witnesses in the Aarushi-Hemraj murder case trial.

A bench of justices BS Chauhan and Dipak Misra said CBI cannot be compelled to summon all its witnesses in the case and the couple can file an application for examining those witnesses including ADG (Law and Order) of Uttar Pradesh and then CBI Joint Director Arun Kumar.

“Why are you in hurry. Recording of your statement is going on. After that you try to examine them,” the court said.

The Talwars had moved the apex court challenging the Allahabad High Court order refusing their plea to summon 14 witnesses in the case.

In his statement to the court, Rajesh Talwar claimed that he was asleep on the night his daughter Aarushi and domestic help Hemraj were murdered and said that Internet activity recorded from his room might not be correct.

Talwar’s statement was ecorded under section 313 of CrPC where the judge poses questions directly to the accused to explain his version of the circumstances.
