Vinesh Phogat appeals for Olympic silver: What is the Court of Arbitration for Sport (CAS) that will hear the case?

Vinesh Phogat has appealed against her Paris Olympics 2024 disqualification at the Court of Arbitration for Sports (CAS). The verdict is expected to come on Thursday.

Wrestler Vinesh Phogat was disqualified from the Paris Olympics after being found to be overweight. Reuters

Vinesh Phogat has moved to the Court of Arbitration for Sports (CAS), demanding an Olympic joint silver in the 50kg wrestling category after she was disqualified from the final for being overweight by 100 grams at the time of the weigh-in. Vinesh was disqualified on the day of the gold medal match - Wednesday.

The verdict on the matter from CAS is expected to come out on Thursday .

The Olympics website says CAS is an independent body set up in 1983 “to bring about the resolution of sports-related disputes which are submitted to it through ordinary arbitration or through appeal against the decisions of sports bodies or organisations.”

“In 1993 the CAS became entirely independent, by creating a new administration and financing body, the International Council of Arbitration for Sport (ICAS), and adopting a new judgement structure.

“The CAS is recognised by the Paris Convention signed by the presidents of the International Olympic Committee (IOC), the Association of Summer Olympic International Federations (ASOIF), the Association of the International Olympic Winter Sports Federations (AIOWF) and the Association of National Olympic Committees (ANOC), in the presence of the French Minister of Justice.”

The CAS’s headquarters is in Lausanne, Switzerland, and it also has courts in New York City and Sydney.

Vinesh Phogat’s case, however, will be heard in Paris by CAS which has established two temporary offices in Paris for the 2024 Summer Olympic Games.

The first, the CAS Ad Hoc Division, will resolve any legal disputes that arise during the Games. This temporary tribunal has operated at every edition of the Summer and Winter Olympic Games since 1996, as well as at other major sporting events.

Vinesh’s matter will be heard by the CAS Ad Hoc Division.

“The CAS Ad hoc Division guarantees free access to high quality dispute resolution services conducted within a timeframe consistent with the competition schedule as decisions can be rendered within 24 hours in urgent matters,” a statement from the legal body said.

The second temporary office is for the CAS Anti-Doping Division which will adjudicate anti-dopingrelated matters arising during the Games. This structure, in operation since the Rio 2016 Olympic Games, will handle potential doping cases referred to it by the International Testing Agency (ITA) in accordance with the International Olympic Committee (IOC) Anti-doping Rules.

Both offices will be located within the Paris judicial court in the 17th arrondissement of Paris and will operate from 16 July 2024 until 11 August 2024.
