‘There's right to speech but where’s your duty?’: SC grants bail to prof arrested over Op Sindoor post

Haryana Police arrested the professor after two FIRs were registered against him, alleging his social media posts on Operation Sindoor endangered the sovereignty and integrity of the country. He was later sent to judicial custody till May 27

The Supreme Court on Wednesday granted bail to Ashoka University professor Ali Khan Mahmudabad for his Facebook post on Operation Sindoor, saying that while there is a right to speech, he should be more mindful about discharging his duties.

The court noted that in his post, Mahmudabad “expressed his opinion on the war and turned it to politics”.

“You should know what is happening. There is a right to free speech, etc..  Where is the duty? As if the whole country for the last 75 years has only been distributing rights and no duty," a bench of Justices Surya Kant and NK Singh said.

“Having regard to two online posts that have led to FIR registration, we are satisfied that no case of staying the investigation is made out. But to have an understanding of the propensity of the word use, we direct the DGP of Haryana to constitute an SIT with 3 officers not belonging to Haryana/Delhi. One of the officers to be a woman officer…. We direct the petitioner to be released on bail," it added.

Last week, Haryana Police arrested Mahmudabad after two FIRs were registered against him, alleging his social media posts on Operation Sindoor endangered the sovereignty and integrity of the country. He was later sent to judicial custody till May 27.

The FIRs were lodged at the Rai police station in Sonipat district – one based on a complaint by the chairperson of Haryana State Commission for Women, Renu Bhatia, and the other on a complaint by a village sarpanch.

Senior Advocate Kapil Sibal, representing Mahmudabad, read out the post in question in court today and said, “With the greatest respect, this is a patriotic statement.”
