New Delhi: With terror suspect Fasih Mahmood’s deportation from Saudi Arabia and subsequent arrest in the national capital, his lawyer is busy preparing for a legal battle. In the initial stage, Fasih’s lawyer, Syed Irfaan Alam, said he would file four applications before metropolitan magistrate PK Jain. Aalam will press the court to send Fasih to judicial custody and not police custody. He will ask the court to direct the police to address Fasih as an ‘accused’ and not ’terrorist’. They are described as terrorist even if when the charges have not been proved in court. It is no less than a blot for the entire family,” he said. Aalam said that he would also ask the court to allow the accused meet his wife Nikhat Parween, who has been campaigning for his release. “We want courts permission to meet Fasih for ten minutes,” he said. An application will also be moved to enable Fasih to meet his lawyer so that he could be briefed about the case. Fasih Mahmood was picked up from his home in Saudi Arabia on 13 May 2012 by men believed to working for Saudi authorities. He was flown to India and arrested at Indira Gandhi International airport, New Delhi, on Monday. Alam added that he would move a bail application in court, once the charges against Fasih were framed.
