It could turn out to be a tumultuous day in Delhi. Chief Minister Arvind Kejriwal is likely to be arrested today in the Delhi liquor policy case or so the leaders of the Aam Aadmi Party (AAP) believe. The possibility of an arrest comes after Kejriwal refused to appear before the Enforcement Directorate (ED) for questioning in the case. This was the third notice to AAP’s national convenor. He had earlier refused to appear before the agency on two summons issued for 2 November and 21 December. The possible arrest of Arvind Kejriwal The buzz around Kejriwal’s arrest started on Wednesday night after several AAP leaders expressed concern that his house could be raided the following morning and that he could be held. AAP’s national secretary (organisation) Sandeep Pathak wrote in a post on X just before midnight, “Delhi CM @ArvindKejriwal likely to be raided tomorrow early morning by ED.” “News coming out that ED is likely to raid and arrest Delhi CM @ArvindKejriwal. In such eventuality request everyone to stay calm,” he added.

Similar posts were written by Minister Atishi and senior party leaders Saurabh Bhardwaj and Jasmine Shah. Atishi wrote, “News coming in that ED is going to raid Arvind Kejriwal’s residence tomorrow [Thursday] morning. Arrest likely.” “It is clear that they (BJP) want to finish Aam Aadmi Party and arrest Arvind Kejriwal before Lok Sabha elections… He is ready to cooperate with the legal process. Till now, all summons served to him are illegal. From credible sources, we have got to know that a raid will be conducted and Arvind Kejriwal will be arrested,” Shah said while speaking to the media on Thursday.

According to sources within AAP, roads leading to the Delhi CM’s house have been blocked by the Delhi Police. Sources in the police said that arrangements were made outside the ED headquarters for Wednesday. After social media posts by AAP leaders, the North district police made security arrangements outside Kejriwal’s residence. Staff members have alleged that they are not allowed to enter the house. Security has also been tightened outside the AAP office since Wednesday. Kejriwal on Wednesday skipped the third summon issued by the ED in the Delhi excise policy case and sent a written reply calling the notice illegal, AAP sources said. PTI[/caption] A senior Delhi Police officer, however, said the “security was increased to manage the media personnel” after the AAP’s claim of a possible raid at the CM’s house. “No one from the CM staff has been stopped,” another police officer said, terming the increase in the number of police personnel as “general deployment”. The skipping of summons Sources at the ED have said it is likely that the federal agency will issue a fourth summon to Kejriwal, reports CNN-News18. The AAP leader has skipped three summons so far. While Kejriwal has maintained that he was ready to cooperate with the probe in the liquor policy case, he has called the summons illegal. He has asked the ED to withdraw the summons and has refused to come for the interrogation. He skipped the third summons citing Rajya Sabha polls, Republic Day preparations and the probe agency’s “non-disclosure and non-response approach” as reasons for not appearing before it. In a letter addressed to the ED, the AAP leader also said that he would be “happy to answer” any questionnaire sent by it. Now reports say that he will be on a three-day Gujarat visit from 6 January. While in Gujarat, the AAP chief will address his party workers and will also hold public meetings. There, Kejriwal also meet jailed AAP leader C Vasava and his family. Kejriwal’s links to the liquor case Delhi’s liquor sales policy was introduced in November 2021 but was later scrapped in July 2022. Under the policy, the government had nothing to do with selling liquor and allowed only private shops to do so, breaking away from the norm in most states. The AAP government claimed that this would stop black marketing, increase revenue, and enhance consumer experience. The policy allowed liquor shops to stay open until 3 am, home delivery of alcohol and gave licensees the freedom to offer unlimited discounts. The AAP government reported a 27 per cent increase in income from the policy, generating around Rs 8,900 crore. File photo/PTI[/caption] However, trouble started brewing after a report in July 2022 submitted by Delhi Chief Secretary Naresh Kumar to Lieutenant Governor (LG) Vinai Kumar Saxena, a representative of the BJP-led central government, pointed to alleged procedural lapses in the formulation of the policy. According to the report, decisions taken by Manish Sisodia as excise minister led to “financial losses to the exchequer” estimated at more than Rs 580 crore. It alleged that kickbacks were received by the Delhi government and AAP leaders from owners and operators of alcohol businesses. This money was used to “influence” the Assembly elections held in Punjab and Goa in early 2022. The report was submitted to the CBI, which named Sisodia and 14 other accused in its first information report. Investigation into the probe reportedly uncovered fresh evidence with the agency now having grounds to question Kejriwal. PTI[/caption] The AAP arrests in the case AAP leaders Manish Sisodia and Sanjay Singh are accused of corruption in the liquor case. Both leaders were arrested last year. In 2022, AAP’s communications in-charge Vijay Nair was held. Sisodia had not been named in the chargesheet filed by the CBI until his arrest. The ED launched a separate probe in the case, alleging money laundering. It claimed that a liquor lobby – the “South Group” – paid at least Rs 100 crore in kickbacks to AAP for its Goa election campaign. Last year, the Supreme Court rejected Sisodia’s bail and stated that a money trail of Rs 338 crore was “tentatively established” in the case. It also said in October that if the trial proceeded sloppily, he will be able to apply for bail within three months. The ED filed a supplementary chargesheet, naming him as an accused, alleging his involvement in conspiracy, money laundering, and aiding the other accused. AAP vs BJP on Kejriwal’s possible arrest Once again, the AAP and BJP are trading barbs over the case. Delhi minister Saurabh Bhardwaj has accused the BJP of hatching a conspiracy to arrest Kejriwal so that he would not campaign for the upcoming Lok Sabha elections. Talking to the media he asked, “Why is he being summoned just before the polls? The Centre is hatching a conspiracy to arrest Kejriwal before the polls.” AAP’s chief national spokesperson Priyanka Kakkar told ANI, “We are hearing it continuously that Arvind Kejriwal will be arrested. BJP leaders are saying such things. Three of our leaders are in jail for a long time without any evidence against them and for the sheer reason that BJP can’t compete with Arvind Kejriwal in policies… Absconders are those who join BJP to escape investigation and we have a fairly long list of such people.” [caption id=“attachment_13574632” align=“alignnone” width=“640”] Security personnel deployed at the Rajghat in Delhi on Wednesday. PTI[/caption] Hitting back at AAP, the vice president of BJP’s Delhi unit, Kapil Mishra posted a video message on the Delhi CM on X. “Arvind Kejriwal’s attitude is like that of a professional criminal. Running away from investigation and playing the victim card. By running away from investigation, Kejriwal is insulting the law and the Constitution.
