New Delhi: The 1993 Mumbai blasts absconding mastermind Tiger Memon’s brother’s plea seeking relief from his conviction and life sentence on the ground of him being a chronic schizophrenic was today dismissed by the Supreme Court. The apex court dismissed Yusuf Memon’s appeal, agreeing with CBI’s submission that the Memons, including Yusuf, Rubina and Essa resided together at Al-Hussaini building and were present when several conspiratorial meetings had taken place in the their flats in that building. AFP[/caption] “It is, therefore, clear that they knew about the conspiracy and facilitated the commission of acts pursuant to the said conspiracy,” the court said. Yusuf had in his appeal told the court that he is suffering from chronic schizophrenia and the flat at Al-Hussaini was purchased by his father jointly with him since his father was managing his savings. He had also taken the plea of his clear antecedents. The apex court bench of justices P Sathasivam and BS Chauhan said Yusuf, Rubina and Essa resided jointly at these flats where Tiger Memon, Yakub Memon and their associates hatched the criminal conspiracy to carry out multiple explosions in Bombay. “The conduct of the appellants in not reporting any of these activities to the police and the fact that Yusuf and Rubina departed from India on March 11, 1993 in itself is an incriminating circumstance to be used against them. “None of the appellants responded to the proclamation requiring presence issued by the designated court, which was given wide publicity. This is also a proof that all the Memons’ were fully aware of the blasts and their conduct in fleeing away very clearly establishes that they were aware of the blasts and association of Tiger Memon with the blasts,” the court held. Yusuf had earlier been granted bail by the Supreme Court. PTI
