Communications Minister Fahmi Fadzil declared Malaysia’s unequivocal stance against the establishment of prostitution dens, emphasising that the country’s laws expressly prohibit such activities. Speaking on Tuesday, Fahmi asserted that any initiatives must align with existing laws, categorically stating, “The opening of brothels will never be allowed in Malaysia.” Fahmi responded to actor Rosyam Nor’s suggestion on the Hitam Putih Kehidupan podcast that prostitution dens be made available for the “convenience” of male foreigners separated from their wives in their home countries. Fahmi aligned himself with Minister in the Prime Minister’s Department (Religious Affairs) Dr Mohd Na’im Mokhtar, who deemed the proposal contrary to both civil and Sharia laws. Expressing agreement with Dr. Mohd Na’im Mokhtar, Fahmi remarked, “I think the religious minister’s statement calls for sincere self-reflection by all of us. I agree with him; you cannot treat this kind of thing.” Responding to inquiries about potential regulation of podcast content, Fahmi revealed, “We don’t have a plan yet, but you just gave me an idea.” Dr. Mohd Na’im Mokhtar highlighted the proposal’s conflict with Islamic teachings and Maqasid al-Sharia (Islamic law). He underscored the Sharia Criminal Offences (Federal Territories) Act 1997, citing provisions related to prostitution (Subsection 21), procurers (Section 22), and extramarital sex (Section 23). According to Act 559, penalties are outlined for organising, encouraging, or promoting vices under Section 35. Dr. Mohd Na’im Mokhtar urged societal opposition to the proposal, branding it unacceptable and emphasising that it has stirred controversy, given the illegality of prostitution in Malaysia. In a statement, Dr. Mohd Na’im Mokhtar advised the public against making statements that could incite polemics or go against Islamic teachings. The firm rejection of the proposal reflects Malaysia’s commitment to upholding its legal and religious principles.
