TRAI takes Loop Mobiles to court over MNP

TRAI takes Loop Mobiles to court over MNP

The latest service provider to have found its head under TRAI’s axe for having allegedly rejected several mobile number porting requests by their subscribers in their Mumbai circle is Loop Mobiles (India) Ltd. and the TRAI seem to be in no mood for going soft on them. A Times of India report confirms that miffed with Loop Mobiles (India) Ltd. rejecting MNP requests, TRAI have approached a Delhi court and have placed a request with Chief Metropolitan Magistrate, Vinod Yadav to summon and prosecute Loop Mobiles and its top officials. The Telecom Regulatory Authority of India (TRAI) has not been the one to let it pass, since even in the past, they came down heavily on donor operators, rejecting MNP requests sent by their subscribers, citing it as illegal.

The report further quotes TRAI, in their complaint, as saying that, “Regulation 12 (Telecom Portability Regulations) does not provide for rejection of porting requests on the ground of act of God and rejection under the category are not in consonance with the provisions of the said regulation.” Further, according to the report, when TRAI went ahead to obtain data details regarding Loop Mobiles’ response to subscriber requests for MNP, it found that the company had rejected several such requests. TRAI, when decided to seek information to support its claims from Loop, the latter rejected them.

In one of our earlier reports, we had reported about TRAI’s order to telcos, asking them to refrain from rejecting MNP requests by their subscribers. TRAI, while reporting that since its launch, last year, they have been witnessing a rise in the “percentage of rejections of the porting requests of subscriber”, stated that several operators were found to have been asking for cancellation requests, either in a written form, or through an SMS or a voice call from the subscriber. The TRAI, back then had started clearly that barring a few exceptional cases as mentioned under the regulation 12 of the regulations, asking for such requests is illegal.
