Samsung fails to score iPhone, iPad ban in Netherlands

Samsung fails to score iPhone, iPad ban in Netherlands

An update to the longstanding Apple Inc. vs Samsung Electronics patent lawsuit comes from the Hague court in Netherlands. Samsung Electronics, who had approached the Dutch court with a 3G patent bid against Apple, reportedly failed to get the sales of the Cupertino-based company’s iPhone and iPad banned in Netherlands, thereby dealing a blow to Samsung’s hopes in the country.

However, according to reports, Samsung has confirmed that the court, while rejecting its plea to get the popular Apple products banned, agreed to let Samsung to seek damages for the use of Intel chips. Samsung, thereby claims that it has managed to score a partial victory against Apple in Netherlands. Further elaborating on the specifics of their partial victory in Netherlands, Samsung stated that they cannot press lawsuit claims against Apple’s products that use Qualcomm’s baseband chips, but can claim damages for Apple products that use Intel chips.In its statement, Samsung affirmed that, “(The) ruling by the Hague court provides Samsung with a legal basis to move forward with the protection of our patent rights.Samsung has and will continue to stand ready to meet its obligations in licensing its technology on fair and reasonable terms.”

Both, Samsung Electronics and Apple Inc. have been caught in a longstanding patent battle, across several countries, worldwide. Although both companies, still share pious business ties, which came out clearly when reports about Apple approaching Samsung for supplying touchscreen panels for the former’s newest iPad. However, the two continue to bicker over a host of disputed patents and it first began when Apple , sometime in April, last year, accused Samsung for copying the designs of its iPad and iPhone and incorporated it into their own products. Since then, both companies have been suing and countersuing each other in different courts the world over. Apple sought to get the several of Samsung’s products banned, including the latter’s Galaxy Tab 10.1 tablet, Galaxy Nexus smartphone, Galaxy Tab 8.9 tablet, among others. Samsung, too, has had its sights on Apple’s iPhone, iPad models.
