Ericsson concealed info, Xiaomi interim injunction revoked by Delhi HC: Report

It is believed that the Delhi High Court has agreed in part with Xiaomi that Ericsson concealed relevant information about two of its 3G patents, and has withdrawn the interim injunction on Xiaomi as it was based on these patents.

It is now believed that the Delhi High Court has partially agreed with Xiaomi that Ericsson concealed relevant information about two of its 3G patents. Hence, it has now withdrawn the interim injunction on Xiaomi as it was based on these patents. According to a report by Spicyip , the patents in question involve two of Ericsson’s 3G patents; IN229632 and IN240471. Other than these, there are six more patents that Ericsson claims Xiaomi infringed on, including five AMR patents and 1 Edge patent. The Delhi High court had declared a ban on the sale of Xiaomi handsets in India after Ericsson accused the latter of infringing upon its patents. The court had restrained Xiaomi and its agents from making, assembling, importing or selling  its devices which infringe the mobile phone technology patented by Ericsson. In less than a year after of its launch in India, Xiaomi became one of the biggest players in the smartphone industry, posing as a tough competitor to Samsung and Micromax. India had also become the second largest market for Xiaomi after its home country China. Ericsson stated it had invited Xiaomi to use its patented technology by obtaining a license, but instead of doing so, the Chinese manufacturer launched its devices in India in July 2014. Ericsson stated that it made attempts for three years to get Xiaomi to buy their licenses for products compliant with GSM, EDGE and UMTS/WCDMA.
