Having been the presiding officer of the hearing, he chose not to have any of this recorded in the record of proceedings and chose not to sign the order. At the very outset, Gogoi ought to have recused himself from the matter.

In effect, Gogoi called a press conference without actually calling a press conference. The hearing was not aimed so much as taking any judicial action but putting out his version of the story.
