RCA suspension misconceived, without jurisdiction: Abdi

The Rajasthan Cricket Association (RCA) has cried foul against its suspension by the BCCI and termed it as “without jurisdiction, due authority and wholly misconceived”. Mehmood Abdi, the permanent RCA representative to BCCI has submitted a detailed reply to BCCI and has claimed that RCA was not at fault by allowing former IPL commissioner Lalit Modi to become the president of the association. Reuters[/caption] In its reply, RCA claimed that it received the show cause notice issued by BCCI on 10 May which was a Saturday via email after office closing hours at 6.11 p.m. It eventually accessed the mail on the morning of Monday, 12 May. The hard copy of the said notice was received on 15 May. Abdi, also the lawyer of Lalit Modi, further states that cannot issue a show cause notice against a full member of the BCCI: “The power to take disciplinary action is vested under Rule 8(n) of the Memorandum and Rules and Regulations of the BCCI in the Board while the composition of the Board is set out in Rule 7 thereof. “No General Body Meeting of the Board has been convened for the purpose of inquiry into conduct of RCA or where it has been decided to take any disciplinary action against the RCA. The show cause notice issued by BCCI, therefore, is clearly in violation for Rule 11 read with Rule 8(n).” Hitting out at the BCCI, Abdi said that “the show cause notice of suspension issued by BCCI to RCA is without jurisdiction, due authority and is wholly misconceived. He added that “in order to remain relevant the BCCI has to reinvent itself as a transparent, participative and evenhanded organization.” PTI
