New Delhi: American national Zohal Hamid today moved the Delhi High Court seeking quashing of the FIR in the molestation case against Australian cricketer Luke Pomersbach after both the parties reached a settlement last night. The petition by Hamid in the High Court is likely to be taken up tomorrow. [caption id=“attachment_319870” align=“alignleft” width=“380” caption=“The cricketer is presently out on bail. PTI”]  [/caption] Pomersbach was arrested last Friday for allegedly molesting her and injuring her fiance Sahil Peerzada after an IPL party in a five-star hotel here. Hamid, Pomersbach and Peerzada made the plea jointly, terming as “unfortunate” the incident leading to registration of the FIR and saying that they have amicably settled their disputes and “wish to end it.” Australian cricketer Pomersbach, playing for Royal Challengers Bangalore (RCB) in IPL tournaments, was arrested on 18 May after Hamid alleged that he had molested her in a five-star hotel here an and beat up her her fiance. “All petitioners are of young age and have a long life ahead of them. They don’t want to wish to blemish each other and wish to end this unfortunate episode of their lives respectively” said petition filed jointly by Hamid, Pomersbach and Peerzada for quashing of the FIR. Claiming that they have reached a settlement amicably without any pressure or financial consideration, the petition said, “The petitioners have reached settlement as per settlement deed dated 23 May 2012, whereby inter se disputes between the parties have been amicably settled without any pressure, coercion or undue influence.” The trio said on the advice of their friends and relatives, they mutually decided to end all their disputes. The trio have also agreed not to make any statement, written or verbal which would defame or, in any way, criticise personal reputation of each other. Pomersbach, playing for Royal Bangalore Challengers in the ongoing Indian Premier League, was later released on bail on the condition that he would not leave the country and contact Zohal. Pomersbach had allegedly hit Sahil when he objected to the cricketer’s alleged misbehaviour with Zohal. In the fight,Pomersbach’s right hand was fractured. The first indication to this out of court settlement came yesterday when Sahil’s brother Feroz claimed they did not want to pursue the case. Feroz had said that Pomersbach should not have done what he did. PTI
