Jitender Singh Tomar was in police lock up on Tuesday night, highlighting the face-off between the Centre and the national capital’s AAP government after his arrest by police on the charge of possessing fake degrees, forcing him to quit. 49-year-old Tomar, MLA from Trinagar and a first-time minister, was remanded to four-day police custody by a city court hours after he was arrested for allegedly forging his science graduation, law mark sheets and a migration certificate. Investigators said that an FIR was registered and the Law Minister was arrested after nearly a month-long investigation established that the documents he submitted in 2011 to register with the Bar Council of Delhi were fake. On late Tuesday evening, Tomar quit as minister and Chief Minister Arvind Kejriwal accepted his resignation, Deputy Chief Minister Manish Sisodia said. It will be sent to the Lt Governor tomorrow morning,” said Sisodia. He said that “after today’s events, Tomar has sent the resignation on his own.” Tomar said he quit “on grounds of morality. But I will fight this case through and win. After this, I will work for the party.” The arrest came in the midst of a raging battle between the AAP government and Delhi Lt Governor Najeeb Jung over the powers of the city government, giving a new political twist to the unsavoury fight. Parallely, the AAP government and Jung continued their fight over the appoinment of ACB chief and an official who issued the order appointing Delhi Police Joint Commissioner MK Meena to the probe agency. Stung by the arrest, AAP unleashed a stinging attack on the Modi government accusing it of political vendetta and creating an “Emergency-like” situation in Delhi to avert the city government’s crackdown on corruption. One of the AAP leaders alleged that the arrest “conspiracy” was hatched in the Union Home Minister’s office at the behest of Prime Minister Narendra Modi and the party would not be cowed down but fight back. Home Minister Rajnath Singh rubbished the charge saying his ministry did not order the arrest which Police Commissioner BS Bassi said was done within the purview of law and after following due procedures. An FIR was registered against Tomar last night in Hauz Khas Police Station and today he was slapped with charges under sections of IPC relating to cheating and criminal conspiracy. Tomar was interacting with a group of people in his office in Trinagar when about 30-40 policemen took him away on the pretext of getting some documents and then drove him to the Hauz Khas police station, according to his staff. Terming the arrest “totally unconstitutional”, Delhi Deputy Chief Minister Manish Sisodia said it was an attempt by the Modi government to “teach AAP a lesson” and asserted that no one involved in corruption will be spared. “Attempts are being made to create an Emergency-like situation in Delhi through dictatorship as we have come down hard on those involved in corruption,” said Sisodia. Accusing police of treating Tomar as a “mafia”, Sisodia said they forcibly put him into a car without giving any specific reason and seized his vehicle before bringing him to the police station. “Tomar was arrested as if he was a mafia. Was he running away? Did he set off a bomb? What was the emergency, especially when a scam is being reopened? There’s a deep underlying reason behind his arrest. “This is an attempt to teach AAP a lesson. We would not spare anyone who will come in the way of our fight against corruption. His college affidavit clearly states that he has passed his law degree,” Sisodia said. Both BJP and Congress demanded resignation of Chief Minister Arvind Kejriwal taking moral responsibility. In the court, police sought five-day custody of Tomar saying his educational certificates relating to law degree were “fabricated” and he was required to be taken to Faizabad in Uttar Pradesh and Bhagalpur in Bihar to ascertain the authenticity of his educational qualifications. However, the court granted four day’s custody. At a press conference, Delhi Police said KS Saket Post-Graduation College in Ayodhya have told the investigators that no B Sc degree and marks sheets were issued in the name of Jitender Singh Tomar. The police said the Tilkamanjhi University in Bihar’s Bhagalpur also termed Tomar’s law degree fake. Delhi Police Commissioner BS Bassi told reporters that the police was now probing whether the fake degree issue was a bigger racket in the country.
“The most important aspect of this case is that the documents were fake. If they are false, then who made it? Were fake documents made for other people too? And since when was this racket on?” Bassi said. “Investigating officer needs to collect information.”
Referring to Tomar as ‘mananiya (respected) Tomarji’, Bassi further said, “Our experience is that if someone uses fake documents, it’s not just for one person…To maintain educational standards in the country, it is our duty to investigate this properly and stop the racketeer and the people helping them.”
Bassi also said that the police had a lot of evidence against Tomar in this case.

“Arrest is only necessary in cases where person may escape, is likely to commit the same offence or is likely to tamper with evidence,” Bhushan said.
“In Jitender Tomar’s case, the only apprehension police may have had is that he may try to tamper with evidence…If that’s the case, perhaps arrest may have been justified. But in such cases, arrest is not usually justified,” he said.

Tomar was arrested only after concrete evidence against him was found, says police
Investigators said that an FIR was registered and Tomar was arrested only after finding concrete evidence of his wrongdoing following a complaint by Bar Council of Delhi Secretary Punit Mittal on 11 May.
Once police received the complaint, a preliminary enquiry, as per the directives of the Supreme Court, was launched and two teams were sent to verify the documents attached with the complaint to RML Avadh University, Faizabad and Tilak Manjhi Bhagalpur University in Bihar, they said.
“In the record of KS Saket PG College, Ayodhya from where the alleged B.Sc degree and mark-sheets were issued in the name of Jitender Singh Tomar, no such student was found in the college admission register while roll numbers mentioned in the documents were not found in the university record,” said Delhi Police spokesperson Rajan Bhagat.
When the police team contacted the Controller of Examination of RML Avadh University, he reported that no B.Sc degree and mark-sheets in the name of Jitender Singh Tomar have been issued by the University as per their record.
Interestingly, admission record of VNSL Studies, Munger, Law College showed that Tomar has obtained the B.Sc degree from RML Avadh University, whereas in the record of Tilak Manjhi Bhagalpur University, he has shown to have been migrated from Bundelkhand University. – PTI

Congress leader Ajay Maken slammed Arvind Kejriwal and said he should resign due to Tomar’s fake law degree issue.
“The moral responsibiliyy lies with Kejriwal. It was he who selected the minister, despite knowing that he had a fake law degree. In order to have a free and fair trial, Kejriwal should also resign.”
Maken also said that the AAP government had failed to bring about Jan Lokpal or Lokayukta since they had come to power. He also said that there were charges against other eight ministers.
“It’s not only the law minister. There are 8 other MLAs against whom there are cases in different police stations What will happen to complaints against those 8 MLAs if there is no Lokayukta?” said the Congress leader.
“It is very sad that the AAP, which had talked about honesty, is involved in this controversy,” he said.

After reaching Faizabad, Tomar was surrounded by a group of reporters questioning him about the controversy. Tomar slammed the Centre for his arrest, alleging that it was a conspiracy against him and said, “There is nothing wrong with my degree.”
When asked by a reporter whether the AAP government in Delhi was not being allowed to work, Tomar said, “Definitely.”
