Delhi gangrape: Accused tell court they fear for their lives in Tihar

Dramatic scenes played out in the fast track court hearing the Delhi gangrape case after accused Vinay Sharma arrived in court with his right hand in a plaster.

Demanding immediate transfer of accused out of Tihar Jail, Vinay Sharma's lawyer AP Singh told the court, "he is scheduled to appear for an entrance exam on Sunday. His right hand has been broken by other inmates. Please transfer him immediately out of Tihar and summon the jail superintendent in court today itself."

Accused Akshay Thakur had complained to the judge on Thursday that he was being threatened by a jail official. AFP

Singh told the court that he had grave apprehensions about the safety of the accused. "They will all be killed. I've lost all my faith," he said. (Vinay Sharma had on Thursday applied for a two-day interim bail to appear for a category-C Air Force entrance test scheduled on Sunday.)

Incidentally, another accused, Akshay Thakur had complained to the judge on Thursday that he was being threatened by a jail official.

These revelations come less than a month after main accused in the case Ram Singh was found hanging in his prison cell in the high security Tihar Jail.

Supporting Singh's plea, defence counsel ML Sharma, representing accused Mukesh, brother of Ram Singh, told the court, "The perpetrators should be booked for murder. An FIR be lodged and action be taken immediately."

Expressing concern over the developments, senior public prosecutor Dayan Krishnan told the court, "I am extremely disturbed. It troubles me to see the accused like this."

The prosecution seconded the defence's request to summon the concerned jail superintendent.

Strongly objecting to the accused being called by the defence to make a statement before the court, the prosecution, urged the defence to desist from 'making a spectacle' and not create 'drama' in court.

Singh in his application seeking transfer of all the accused to Rohini Jail stated that Vinay Sharma on 4 April (Thursday) was 'brutally assaulted by other inmates' and suffered injuries "on his whole body and his right hand got fractured" and that Akshay Thakur had been abused.

Contesting the hospital's medical report of Vinay Sharma, who was taken to GB Pant hospital, Singh said it wrongly stated that the history of the fracture was a fall and that his client's arm was broken by other inmates.

He urged the court to take all necessary steps for the safety and security of the accused in the intervening time.

Sharma also moved an application for immediate transfer of accused out of Tihar and that they should not be sent back to Tihar today.

The court has ordered a complete medical report, including X-ray, of Vinay Sharma and Akshay Thakur to be submitted and has summoned the jail superintendent of jail number seven (where Vinay Sharma is lodged) to appear in court on Saturday.

The court further ordered that the jail superintendent file a report on whether he had recorded the allegation of the accused and if any action was taken.

The court also directed the jail authorities in the meantime to ensure safety and security of the accused.

The judge noted that one of the accused had already expired in custody and that on 11 March the court had directed jail administration to ensure safety of the accused.

In other developments, the prosecution opposed the interim bail application of Vinay Sharma. The order on Sharma's bail will be passed on Saturday.
