Unhappy with Mayawati's alleged remarks on caste lines: HC

Lucknow: Taking serious note of Uttar Pradesh Chief Minister Mayawati’s alleged statement on caste lines, the Allahabad High Court today said a person holding constitutional post should not make any statement “which shall prove to be divisive in due course of time”. The Allahabad Bench of the High Court gave six weeks’ time to the Centre and state government to file their replies on a writ petition filed by Brahman-Kshatriya Mahasangh seeking direction to Mayawati desist from making any statement on caste lines. PTI”] ![](https://images.firstpost.com/wp-content/uploads/2011/12/MAYAWATI-PTI2.jpg "Mayawati addresses press") [/caption] A division bench comprising Justice Devi Prasad Singh and Justice Devendra Kumar Arora, however, declined to issue notice to Mayawati in this matter. The court observed in its order that “prima facie, it appears that once a person took an oath of office of a constitutional post in any wing of the government, judiciary or legislature or hold a public office, for such persons the entire country is one and action of such person must be beyond caste, creed or religion so as to create casteless or classless society in the country. “Such persons should not make statement on the basis of caste, creed or religion, which shall be divisive in due course of time”. The petitioners have alleged that on 13 November, the BSP president, during the Brahman Bhaichara Sammelan at Lucknow, requested the gathering of Brahmins to vote for her party as the BSP intends to make Rajnath Singh and the Congress Party Digvijay Singh as the Chief Minister of Uttar Pradesh.
