Dec 16 gangrape accused's assault allegations fabricated, court told

New Delhi, May 10 (IANS) Tihar Jail authorities, in a report to the fast-track court trying the Dec 16 Delhi gang rape case, Friday said the contention of accused Akshay Thakur that he has been beaten and suffered injury on the chest is a highly "fabricated" one.

Thakur Thursday alleged that jail officials and inmates had beaten him on his chest following which court directed the jail authorities to medically examine him and file a report.

The report filed before Additional Session Judge Yogesh Khanna said the allegations levelled by Thakur against jail officials and fellow inmates was false as no such incident has ever taken place at the first place.

"It is pertinent, to the allegations levelled by the accused of manhandling by the two Assistant Superintendents, namely Mandeep Dahiya and Jitender Patel, it is to be revealed that no such incident has ever taken place at the first place. His contention that he has been beaten and suffered injury on the chest is a highly fabricated one," the report said.

The medical report of DDU Hospital also said that Thakur was not physically assaulted and has no fresh injury.

The jail report said: "The medical report received from the Senior Medical Officer of the jail and the MLC (medico-legal case) received from the DDU hospital in respect to the accused is hereby appended with this report in order to illuminate the truth and highlight the falsification of the allegation imposed on the jail officials."

It said that since his (Thakur's) arrival in jail, he has been violating the jail rules and regulations and creating huge disturbance and havoc inside the ward where he is lodged.

"He has been ostentatiously bragging that his case being highlighted would falsely implicate whomsoever he wants in a false case and intimidates the jail wardens and other inmates of the ward."

"The accused has been constantly threatening the jail officials that he would deliberately implicate the jail officials and put their job in jeopardy by harming himself either in the jail van or any other secluded place," the report added.

Moreover, it is pertinent to mention that the accused is trying to divert the attention of this court from the case levelling false allegations against the jail officials, the jail authority said in the report.

Jail authorities Thursday told the court that they received a complaint letter by a newly-admitted inmate against Akshay for allegedly misbehaving and violating rules and regulations.

The authorities however, said that Akshay has been misbehaving with the jail officials while he was being taken to DDU hospital for conducting a test on May 9 night.

"Hence it is requested to treat the complaint letter of the accused Akshay Thakur as malicious attempt to browbeat the jail authority and malign the integrity of the jail officials who have been diligently performing to maintain a congenial environment in the jail envisioning the welfare of the inmates of the jail."

The medical officer of the Tihar Jail also submitted a report which said that the accused was referred to DDU hospital for medical examination on May 9 and no fresh injury was seen on his physical examination.

"On his medical examination, his general condition is satisfactory and vitals are stable. No fresh injury is seen on physical examination of the inmate. His X-ray of the chest is also normal as per his treatment card," the report said.

Thakur is in judicial custody along with other co-accused in the gang-rape in which a 23-year-old woman was brutally tortured and gang-raped in a moving bus. She later died in a Singapore hospital.
