New Delhi: A Delhi court has dismissed a complaint of a cameraperson of a news channel against Congress MP Naveen Jindal for allegedly hurting him and attempting to damage his camera at a press conference here last year.

The court rejected the complaint saying video clipping of the alleged incident, produced by complainant Zee News cameraperson Shiv Shankar Yadav, does not show that he was slapped and the visuals only revealed that he was pushed by Jindal.

"If carefully observed, the video clipping does not depict that complainant (Yadav) was slapped at all or that the camera was deliberately attempted to be destroyed by mischief.

"All that is revealed from the video is that accused (Jindal) pushed the complainant," Metropolitan Magistrate Vijeta Singh said.

"Every individual has a right whether or not to be covered by the media and the instance of the like under

consideration is a professional hazard of the complainant," the court said.

Yadav, in his complaint, said that on September 10 last year, he, along with his colleague Deepak Sahu, had gone to cover the Sponge Iron Manufacturers Association Conference at Le Meridien Hotel here.

He alleged that on arrival of Jindal, Chairman of Jindal Steel and Power Ltd (JSPL), reporters started posing certain questions to him regarding stories being aired on news channels pertaining to allocation of coal blocks to his firms and also to the companies managed and controlled by his relatives.

"In view of the previous hostility between the accused and Zee News channel, the accused, on seeing the logo of Zee News on the microphone, got agitated and imputated allegations upon Zee News for broadcasting false and incorrect stories.

"That accused on entering the conference room turned back and charged upon the complainant and his colleague and tried to drop the camera," the complaint had said. The complaint further alleged the act of Jindal was "intentional and deliberate" without any provocation to harm, humiliate and injure Yadav due to personal grudge he bore against the channel.

Yadav also alleged he was slapped by Jindal who had also tried to damage his camera and this was liable to be prosecuted for offences under the IPC.

The magistrate, however, dismissed the complaint saying, "this court is of the view that not only are the essential ingredients of offence punishable under section 323 (voluntarily causing hurt) and 427/511 (attempt to cause damage by mischief) of IPC missing in the complaint but also the evidence of the complainant itself suggests that proceedings further in the matter would be a waste of time.

Therefore, the complaint is dismissed under 203 CrPC.
