Kingfisher Airlines now challenges IT dept over TDS
Kingfisher has claimed in its appeal that the I-T department has wrongfully charged Kingfisher with default under section 201.
Kingfisher Airlines has challenged the IT department at the Income Tax Appellate Tribunal (ITAT) over TDS (tax deducted at source) payments. The Airlines has filed the appeal challenging the TDS claims over the last three years, financial years 2011-2013, reports CNBC TV18.
Kingfisher has claimed in its appeal that the I-T department has wrongfully charged Kingfisher with default under section 201. It also disputes the TDS demand of Rs 304 crore by the I-T department for these three years and the interest on the TDS demand , which sums to about Rs 67.9 crore.
In its appeal, Kingfisher Airlines has said that the I-T order is opposed to law, facts, circumstances, equity and natural justice. It also argues that the notice, proceedings and order are all bad in law, it's without jurisdiction and are invalid.
Kingfisher Airlines has argued that the I-T department did not give adequate opportunity to them to put forth their side of the picture. It has also appealed to the Income Tax Appellate Tribunal (ITAT) to cancel the order by the I-T department.
CNBC TV18 reports the hearing could be sometime in June.
The government had initiated proceedings against the cash strapped airlines alleging that the airlines did not submit TDS despite collecting it from the employers.
