Court lifts ban on Samsung Galaxy Tab 10.1 in Australia

Following a pathbreaking judgment delivered by the Federal Court of Australia, the ban on Samsung's Galaxy Tab 10.1 in Australia has been lifted, fueling the hopes of the South Korean company ahead of the Christmas season. The decision was unanimously delivered by Federal Court Justices John Dowsett, Lindsay Foster and David Yates.

Those following our reports about the Apple - Samsung feud closely would know that Justice Annabelle Bennett had initially put a ban on the sales of the Galaxy Tab 10.1 in Australia, following an appeal by Apple. Recently, Samsung approached the Federal Court of Australia with a request, that of having the ban decision reconsidered, since the future prospects of the Galaxy Tab looked bleak with the ban overshadowing it. Now, a collective decision made by the aforementioned Federal Court Justices negates the ban passed on by Justice Annabelle Bennett. 


However, Apple responded to this judgment by seeking a stay order to the decision passed by Justice Lindsay Foster, and others. Apple seeks this time to appeal against the 'overturning of the injunction' before the High Court of Australia. Currently, although Samsung strongly opposed Apple's appeal, Justice Foster agreed to consider it and subsequently issued a stay of orders until 4pm (AEDST) on Friday.
